Our specialism and expertise are working with pension providers, such as Sipp operators, helping them meet the regulatory requirements, principally those laid down by the Financial Conduct Authority. Consequently, the regulatory support outlined below is primarily aimed at those involved with operating and/or administering regulated member-directed pension schemes.
- Regulatory support
Aimed at established Sipp operators, this service provides periodic onsite reviews that, amongst other things, seek to objectively appraise the firm’s:
- Management information, systems & controls;
- Processes linked to business take-on, combating financial crime, scheme administration, record-keeping, client money, communicating with scheme members and FCA/HMRC reporting;
- Existing compliance procedures and records;
- Client facing literature;
- Scheme member records for both uncrystallised and crystallised funds as well as property and non-standard investments; and,
- General corporate governance.
Linked to the above we provide a series of centrally maintained compliance related procedures, forms and templates to assist firms in meeting their regulatory requirements, as well as a compliance ‘help-desk’ facility. Firms are also kept abreast of regulatory matters through the issuance of regulatory updates and briefings.
Our aim is to work collaboratively with our clients to assist them in maintaining compliance with and reacting to changes in the FCA’s requirements.
- Specific projects
In addition to the ongoing regulatory support service, we also work with firms on specific projects covering aspects of pension administration (both Sipp and SSAS) such as conducting regulatory ‘health-checks’, assessing & developing processes & procedures, carrying-out a due-diligence exercise on an acquisition target (or preparing for sale), helping prepare for a regulatory visit or assisting with regulatory remedial action following a FCA review visit.
- FCA Interaction
We have extensive experience in assisting firms with applications for FCA authorisation (establishing, operating and winding-up personal pensions), variation and cancellation of permissions, change of control (s.178 Notice) and Notifications to the FCA.
- Expert Opinion
Enhance has experience and expertise in providing expert opinion/witness statements in pension-related cases regarding fraud, tax matters, complaint cases (both Court. mediation and FOS cases) and the regulatory perimeter.
